This Agreement contains the complete terms and conditions that apply to your participation in our Fundraiser/Affiliate/REP Program. As used in this Agreement, "SOSpollution” refers to “SOSpollution.com”.

By clicking the “SUBMIT” button you acknowledge that you have read the terms and conditions for the SOSpollution Fundraiser/Affiliate/REP program, understand them, agree with them and accept them.

1) Terms of the Agreement:
The terms of this Agreement will begin upon our acceptance of your Fundraiser/Affiliate/REP enrollment application and will end when terminated by either party.  Either party may terminate this Agreement at any time with or without cause, by giving the other party written notice of termination.   You can earn referral fees only on sales occurring during this Agreement.  SOSpollution may modify the terms of this agreement at any time.  If any modification is unacceptable to you, you may terminate your Fundraiser/Affiliate/REP participation.  Your continued participation in the program will constitute your acceptance of any change(s).

Your Fundraiser/Affiliate/REP status in the program may be terminated for any of the following reasons:
	Annual merchandise sales volume falls below $100 on your anniversary date
	False claims
	misleading hyperlinks used in your advertisements
	Spamming
	Advertising on sites that promote or contain illegal activities
	violation of intellectual property rights.

To qualify as a SOSpollution Fundraiser/Affiliate/REP and to use the site as a Fundraiser/Affiliate/REP Partner you must be at least 18 (eighteen) years of age and a resident of the United States.

ADULT ORIENTED SITES, SITES THAT DISPLAY ADULT BANNERS & PRODUCTS, SITES THAT PROMOTE RACISM and/or HATE AND SITES THAT ARE LOCATED OUTSIDE THE U.S. MAY NOT PARTICIPATE IN OUR PROGRAM.

2) Earned Commissions
As an Fundraiser/Affiliate/REP of SOSpollution you will earn 20% commission per valid order.  Additionally, you earn a 5% Referral Fee (second tier) from sales generated by Fundraiser/Affiliates/REPs you refer to SOSpollution.

To allow ample time for returns, exchanges or canceled orders, eligible payments due for orders generated on Fundraiser/Affiliate/REP Website eStore will be held for 25 to 60 days after the shipping date of an order. Orders, if item is in stock, will be shipped within 2 to 3 business days after an order is placed.

Commission payments for the previous month orders are sent on or before the 25th of the month following.  The minimum monthly commission payment amount is $10.

Any fraudulent, duplicated, or any other type of misleading orders submitted will be deleted and NO CREDIT will be given.

An associate of SOSpollution will verify all orders submitted before issuing credit to Fundraiser/Affiliates/REPS.  All orders submitted will be encoded with the Fundraiser/Affiliate’s/REP’s number and submitters’ IP address along with proprietary security features.

3) Website/e-Mail Links
Fundraiser/Affiliates/REPs may use graphic and text links both on their Website and in emails.  Fundraiser/Affiliates/REPs may also use the text and graphics provided to you by SOSpollution to advertise in classified ads, magazines and newspapers.  A Fundraiser/Affiliate/REP may create graphics and text of his/her own to be used in advertising as long as SOSpollution approves the material first.

4) Website/e-Mail Tracking
When a web surfer buys an SOSpollution product by clicking through your SOSpollution supplied Website/e-Mail link, their IP address is tracked along with your Fundraiser/Affiliate/REP ID and a cookie is set in their browser.  Should they make a purchase later they can be tracked to your Fundraiser/Affiliate/REP link and the commission will be awarded to you.

5) Limitation of liability:
SOSpollution will not be liable for indirect, special or consequential damages (including but not limited to damages for any loss of revenue, profits, business interruption, loss of business information or data, loss of goodwill, work stoppage, hardware or software failure, or other pecuniary loss) arising from or relating to any provision of this Agreement or the Program, even if we have been advised of the possibility of such damages.  Without limiting the foregoing SOSpollution’s aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to the Affiliate under this Agreement.

6) This Agreement will be governed by the laws of the United States and the State of New Jersey, without reference to rules governing choice of laws, Any action relating to this Agreement must be brought in the state courts located in New Jersey, and the Affiliate irrevocably consents to the jurisdiction of such court.  You may not assign this Agreement without our prior written consent.
